HB5823 - Reproductive Liberty and Justice Act

• Establishes reproductive health centers throughout Illinois to provide comprehensive reproductive health care services including prenatal care, labor and delivery, contraception, abortion care, and substance use disorder treatment.

• Removes newborn substance exposure from definitions of child neglect, eliminates prohibition on licensed certified professional midwives performing abortions, and protects healthcare providers from disclosing toxicology test results to law enforcement without a search warrant.

• Creates "Plans of Safe Care" for pregnant and postpartum individuals affected by substance use disorders, protecting these plans from disclosure in child welfare and adoption proceedings.

• Establishes "Liam's Law" requiring hospitals to notify gestational parents of their right to obtain a certificate of birth resulting in stillbirth for fetal deaths at 20+ weeks gestation.

• Expands patients' rights during pregnancy and childbirth, including non-disclosure of screening questions and toxicology test results related to substance use, and protects reproductive health information from disclosure to out-of-state law enforcement.
