Court orders incarcerated persons to Department of Human Services (DHS) for mental health treatment; state must reimburse county if DHS does not provide bed space within 30 days of sheriff notification.

Reimbursement covers all costs of maintaining the person in county jail beyond the 30-day period after notification to DHS.

Provision applies to persons charged with offenses ordered to DHS treatment under criminal procedure; persons ordered to DHS treatment under Unified Code of Corrections or Mental Health Code who are imprisoned for misdemeanors, sentenced to county impact incarceration, or sentenced to periodic imprisonment.

Amends Section 5 of the County Jail Act (730 ILCS 125/5) to add subsection (d) establishing the state reimbursement obligation for DHS treatment bed space delays.
