SB0208 - Paid Leave for All Workers Act

• Requires all Illinois employers to provide employees with a minimum of 40 hours of paid leave per 12-month period that can be used for any reason.

• Paid leave accrues at a rate of one hour per 40 hours worked; employees become eligible to use accrued leave 90 days after employment begins.

• Employers may set a maximum 2-hour minimum increment for leave usage and can require 7 days' notice for foreseeable leave; employers must provide written notice of paid leave policies to employees.

• Excludes certain workers including railroad employees, part-time students at colleges/universities, and employees covered by collective bargaining agreements (with exceptions for State agency agreements after July 1, 2024).

• Violations subject employers to civil penalties of $2,500 per offense, with additional damages including actual underpayment, compensatory damages, attorney's fees, and penalties of $500-$1,000 per violation; Department of Labor administers and enforces the Act.
