• Individuals with a determination of need (DON) score of 29 or higher shall be eligible to receive services through the Community Care Program, services to prevent unnecessary institutionalization, and supportive living facilities services, effective July 1, 2023.

• On and after July 1, 2023, level of care eligibility criteria for home and community-based services for medically fragile and technology dependent children shall be no more restrictive than criteria in place on January 1, 2021.

• Effective July 1, 2023, the DON score threshold for applicants for institutional long term care increases to 37, subject to federal approval and executed inter-agency agreements between the Departments of Healthcare and Family Services, Human Services, and on Aging.

• From July 1, 2023 through June 30, 2025, nursing facility stays begun before July 1, 2023 for individuals with DON scores between 29-36 may continue coverage if the facility documents service offerings and monthly reassessments, with the Department setting maximum utilization limits by rule.

• The Department shall pursue federal approvals and implement necessary measures to carry out all changes in this Act.
