Wipes Labeling Act Summary

• Requires manufacturers and sellers of premoistened disposable wipes (including baby wipes, bathroom cleaning wipes, disinfecting wipes, and similar products) to label packages with "Do Not Flush" warnings and symbols, effective July 1, 2022.

• Specifies labeling requirements based on packaging type: cylindrical containers must display warnings on the principal display panel or flip lid; flexible film packages must display symbols on front and side panels; rigid/refillable tubs and bulk packages must display warnings prominently where visible during use.

• Prohibits manufacturers from making any claims about flushable attributes, benefits, performance, or efficacy of covered wipes products through product names, endorsements, or marketing depictions.

• Authorizes jurisdictional wastewater authorities (sanitary districts, water reclamation districts, municipalities, and counties) to enforce the act with civil penalties up to $2,000 for first violations, $5,000 for second violations, and $10,000 for subsequent violations; allows 90 days for compliance after written notice.

• Restricts home rule units from regulating wipe labeling in a manner inconsistent with state requirements under this act.
