Allows nonprofit private special education facilities in Illinois that serve only students referred by public school districts to require monthly tuition payments from school districts prior to providing services, rather than only after services are provided.

Requires private special education facilities to refund school districts any tuition collected for days students were not enrolled by the end of each regular and summer school term.

Permits the State Board of Education to order refunds of tuition funds for days when a facility was found in noncompliance with special education rules and regulations.

Maintains existing provisions capping tuition reimbursement at $4,500 per year unless higher costs are approved by the Illinois Purchased Care Review Board, with state reimbursement available for costs exceeding the district's per capita tuition charge.

Takes effect immediately upon becoming law.
