SB1085 - Educational Planning Services Consumer Protection Act (Segura Law)

• Prohibits educational planning service providers from charging upfront enrollment fees, setup fees, or maintenance fees; consumers may only pay for services actually provided.

• Requires written contracts signed by both parties that clearly disclose the provider's name, address, phone number, itemized service descriptions with fees, and cancellation rights.

• Mandates providers issue a Consumer Notice and Rights Form stating that similar services are available free through the Illinois Student Assistance Commission, public libraries, and higher education institutions.

• Allows consumers to cancel contracts at any time before full service completion and receive full refunds of unearned fees within 5 business days; voids any contract that attempts to waive these protections.

• Prohibits providers from advising consumers to provide false financial information, including advising them to pursue court-ordered guardianship to artificially qualify for need-based financial aid; violations constitute unlawful consumer fraud practices enforceable by the Attorney General.
