Rental companies must obtain written agreement from renters before selling a damage waiver at or prior to executing the rental agreement.

Rental companies may void a damage waiver for specific reasons including use for commercial transport, racing activities, intentional criminal acts, and auto business operations.

Damage waivers may be voided if the rental vehicle is operated by an unauthorized driver or by a driver convicted of driving under the influence under Illinois Vehicle Code Section 11-501(a).

Adds new ground to void damage waivers if a stolen rental vehicle is not reported to police within 24 hours of discovery and the renter fails to return the ignition key and key tag or cooperate with law enforcement investigation.
