IL SB1566

Adds "pregnant or is" language to factor (18) to clarify that pregnancy is a mitigating sentencing factor, joining parenthood of a child or infant as grounds for withholding or minimizing imprisonment.

Expands factor (18) to include two new considerations: likelihood that the child will become a dependent minor under the Juvenile Court Act and the best interest of the child.

Requires courts to consider Family Impact Statements presented by defendants at sentencing and to impose sentences allowing parents to continue caring for children unless the parent poses significant community risk that outweighs harm from removal.

Establishes that courts must impose sentences in accordance with mitigating factors unless finding the defendant poses significant risk to the community outweighing the harm of family separation.
