Secretary of State may authorize filing of documents with electronic signatures through administrative rules adoption.

Administrative rules must specify the type of electronic signature required, manner of affixing to records, eligible transaction types, compliance certification procedures, and implementation date.

Entities providing electronic signature services to third parties must apply for and obtain certification of compliance from the Secretary of State, with no limit on number of certifications issued.

Electronic signatures must be executed with intent to sign, attached to the document, capable of reliably identifying the signer, linked to prevent tampering, and compatible with industry standards.

Accepted electronic signatures and electronically delivered records have the same legal force as manual signatures and physical delivery, and are admissible in all administrative, quasi-judicial, and judicial proceedings.
