SB1709 Summary

• Pet shop operators may only offer dogs or cats for sale if obtained from animal control facilities or animal shelters (in-state or out-of-state) that comply with sourcing restrictions.

• Animal control facilities and shelters supplying dogs or cats to pet shops cannot be breeders or obtain animals from breeders, resellers, or auction sales in exchange for payment or compensation.

• Pet shop operators must maintain records for 2 years documenting each dog or cat's source, including the facility name, address, phone number, and proof of compliance with sourcing requirements; records must be submitted to the Department on May 1 and November 1 annually.

• Pet shop operators must microchip all dogs and cats before sale and disclose sourcing information, medical history, price, breed, age, and other details to customers in writing with signed acknowledgement.

• Administrative fines change from discretionary to mandatory: $500 for first violation, $1,000 for second violation within 3 years, and $2,500 plus probationary status for third violation within 3 years; Act takes effect 180 days after becoming law.
