IL SB1733

Amends the Cemetery Protection Act to add a definition of "cemetery consumer" as the interment, entombment, or inurnment right owner(s) and their heirs

Places responsibility on cemetery consumers to repair, replace, or remove dilapidated or unsafe columbariums, niche buildings, mausoleums, or private estates within cemetery grounds, unless the contract specifies otherwise

Authorizes cemetery authorities to take remedial action when consumers fail to address unsafe structures, including temporarily relocating urns or caskets without a permit to complete repairs

Exempts cemeteries from financial responsibility for property damage caused by consumer actions/neglect, acts of God, war, vandalism, or aging/design of structures

Requires cemetery authorities to notify next of kin via email or certified mail when taking remedial action, including details about the repairs, whether remains were moved, payment responsibility, and that records will be maintained permanently
