Establishes public policy that parties to residential real property sales who must pay for title insurance have the right to choose their title insurance company and agent.

Prohibits lenders and title business producers from requiring borrowers obligated to pay for title insurance to use a specific title insurance company or agent as a condition of loan approval or providing services.

Adds that consumers obligated to pay for title insurance must be afforded the opportunity to make an informed decision and have the option to consult with legal counsel before title insurance payment obligations become effective.
