SB1836 Summary

• Amends the Nurse Agency Licensing Act to define "long-term basis" as placement of a nurse or certified nurse aide at a health care facility for more than 24 continuous months where the nurse agency incurs specified expenses (educational materials, credentialing, travel, lodging).

• Defines "temporary basis" as initial employment, assignment, or referral for an undefined duration or 24 continuous months or less, excluding extensions.

• Prohibits nurse agencies from entering into non-compete agreements with nurses or certified nurse aides placed on a temporary basis; makes such agreements illegal and void if entered after July 1, 2022.

• Allows non-compete agreements for long-term placements (more than 24 months) until December 31, 2027, with term concurrent to the initial placement period; permits recovery of actual damages and reasonable expenses during the initial term.

• Requires nurse agencies to submit quarterly reports to the Department of Labor containing average charges to facilities, average compensation paid to employees, and labor-related costs by employee category and county.
