SB1934 Summary

• Amends Illinois Vehicle Code Section 11-501 to establish enhanced penalties for aggravated driving under the influence involving death or serious injury.

• Establishes a Class 2 felony with mandatory imprisonment of 4-20 years for aggravated DUI involving a motor vehicle, snowmobile, all-terrain vehicle, or watercraft accident that results in one person's death and great bodily harm or permanent disability or disfigurement of one or more other persons.

• Maintains existing penalty structures for other aggravated DUI scenarios including third+ violations (Class 2 felony), fourth violations (Class 2 felony without probation), fifth violations (Class 1 felony), and sixth+ violations (Class X felony).

• Preserves existing enhanced penalties for DUI with passengers under age 16, violations during license suspension, and DUI while driving a school bus or vehicle-for-hire.

• May be referred to as "Lindsey's Law."
