IL SB1940

Allows respondents subject to emergency domestic violence orders to petition the court for expungement of all related records from court files and the Department of State Police's Law Enforcement Agencies Data System if the petitioner fails to seek a plenary order before the emergency order expires.

Requires automatic expungement of emergency order records if there is an agreed dismissal, the court denies a plenary order, or the petitioner fails to appear for the plenary order hearing.

Prohibits expungement of records if the respondent violated the emergency order that was issued.

Mandates the court clerk to immediately file the expungement order with the Department of State Police, with all records expunged within 3 business days of the expungement order.

Takes effect June 1, 2021.
