IL SB1967

Allows property owners and certain associations to file restrictive covenant modifications to remove unlawful covenants (those discriminating based on race, color, religion, or national origin) from property records for a fee not exceeding $10.

Requires restrictive covenant modifications to include a complete copy of the original instrument with discriminatory language struck through and a petition signed by the record owner or accompanied by certification of majority agreement from the association's governing body.

Mandates the county recorder submit modifications to the State's Attorney for review within 30 days to determine if the original instrument contains an unlawful covenant and if only discriminatory language is being removed.

Permits the recorder to record the modification only upon State's Attorney approval that it is appropriate, or if the recorder determines the covenant is clearly unlawful without needing State's Attorney review.

Limits liability of county recorders and counties for recording modifications and places all responsibility for unauthorized modifications on the person or entity that executed them.
