Prohibits nursing home residents from receiving unnecessary drugs, defined as those used in excessive doses, for excessive duration, without adequate monitoring, or without adequate medical indications.

Requires informed written consent from residents or their surrogate decision makers before administering psychotropic medications, except in emergencies, with specific documentation requirements for emergency situations.

Mandates the Department adopt rules establishing a protocol for obtaining informed consent that includes discussions with physicians, pharmacists, or nurses about medication risks and benefits, using standardized consent forms.

Prohibits facilities from denying residency based on refusal of psychotropic medication unless the facility demonstrates the refusal would endanger the health and safety of the resident, staff, other residents, or visitors.

Establishes enforcement mechanisms including disciplinary action by the Department, civil penalties up to $500 per day for violations, and allows residents to sue for injunctive relief and damages within 2 years of discovery of violations.
