SB2335 Summary

• Requires Department of Human Services to increase reimbursement rates for residential and day programs serving persons with intellectual and developmental disabilities to fund a minimum $2 per hour wage increase for direct support persons by July 1, 2021.

• Requires Department of Healthcare and Family Services to increase rates for ID/DD facilities and MC/DD facilities effective January 1, 2021 to provide a minimum $2 per hour wage increase for non-executive front-line personnel including direct support persons, aides, supervisors, nurses, and support staff.

• Mandates rate increases for community-based providers serving persons with developmental disabilities based on January 1, 2021 rates to fund at minimum a $2 per hour wage increase and requires employers to certify funds are allocated to direct care staff compensation.

• Amends Illinois Administrative Procedure Act to authorize emergency rulemaking by the Departments of Human Services and Healthcare and Family Services to implement wage increase provisions, with authorization repealing January 1, 2026.

• Takes effect immediately upon becoming law.
