IL SB2454

Designates the Department of Transportation as the state agency responsible for overseeing safety and security of rail fixed guideway public transportation systems in compliance with federal law (49 U.S.C. 5329 and 5330).

Requires the Department to develop, adopt, and implement system safety program standards and establish procedures for review, approval, oversight, investigation, audit, and enforcement of rail transit safety.

Exempts security portions of system safety programs, investigation reports, surveys, and data from discovery in civil court proceedings and provides liability protection to the Department, Regional Transportation Authority, and St. Clair County Transit District for acts under this Section except for willful or wanton conduct.

Requires the Metropolitan Transit Authority and Regional Transportation Authority Service Boards to comply with federal safety requirements (49 U.S.C. 5329 and 5330) as established by the Department of Transportation.

Adds information about rail fixed guideway system safety to the Freedom of Information Act exemptions to protect security-related documents from public disclosure.
