SB2539 Summary

• Requires prescribers to offer naloxone hydrochloride or FDA-approved opioid reversal drugs to patients when opioid dosage is 50+ morphine milligram equivalents daily, opioids are prescribed with benzodiazepines, or patient has increased overdose risk (prior overdose, substance use disorder, or risk of relapse).

• Mandates prescribers provide education to patients and designated caregivers on overdose prevention and naloxone use, consistent with FDA and CDC guidelines.

• Subjects prescribers who fail to comply with these requirements to disciplinary action under their respective licensing boards.

• Does not create private lawsuits against prescribers and does not affect prescriber liability for negligent failure to diagnose or treat patients.

• Exempts patients receiving hospice care from these requirements; effective immediately upon enactment.
