IL SB2975

Creates the Fair Food Delivery Act to regulate third-party delivery services' use of merchant information and intellectual property.

Prohibits third-party delivery services from using a merchant's name, likeness, registered trademark, or intellectual property, or from picking up or delivering orders without first obtaining written consent from the merchant.

Voids any contractual provisions requiring merchants to indemnify third-party delivery services, their independent contractors, or registered agents for damages or harm caused by the delivery service.

Allows merchants to recover actual damages or $5,000, whichever is greater, in civil court, with courts authorized to award punitive damages and equitable relief.

Imposes civil penalties of up to $1,000 per violation, with each day a violation occurs counting as a separate violation.
