IL SB3106

Amends the Illinois Municipal Code to clarify that parcels are "contiguous" if they touch or join one another in a reasonably substantial physical sense OR if they meet the criteria for annexation to a municipality under Section 7-1-1.

Applies the contiguity definition to business districts under the Business District Improvement Act and redevelopment project areas under the Tax Increment Allocation Redevelopment Act.

Declares these changes are declarative of existing law and applies them retroactively to all pending actions, including litigation related to the September 23, 2021 Illinois Supreme Court decision in Board of Education of Richland School District 88A v. City of Crest Hill (except parties with final judgments from that case).

Modifies the definitions in Sections 11-74.3-5 (business districts), 11-74.4-4 (redevelopment project areas), and 11-74.6-10 (industrial/contaminated areas) of the Illinois Municipal Code.

Takes effect upon becoming law.
