SB3209 Summary

• Expands the definition of "practice of pharmacy" to include initiation, dispensing, and administration of drugs, laboratory tests, assessments, referrals, and consultations for HIV pre-exposure prophylaxis (PrEP) and post-exposure prophylaxis (PEP).

• Requires pharmacist-provided patient care services for HIV PrEP and PEP to be reimbursed by Medicaid and other payers at no less than 85% of the rate paid for the same services when provided by physicians.

• Establishes that pharmacists must follow current Centers for Disease Control and Prevention, United States Preventive Services Task Force, or evidence-based clinical guidelines when providing HIV prevention services.

• Requires pharmacists to provide notification to patients' health care providers and maintain appropriate records when delivering HIV PrEP and PEP services.

• Extends Medicaid coverage requirements for all pharmacist-provided patient care services (not limited to hormonal contraceptives) with reimbursement at 85% of physician rates, subject to federal approval.
