SB3692 - Paint Stewardship Act

• Creates a postconsumer paint stewardship program requiring paint manufacturers or representative organizations to submit plans to the Illinois Environmental Protection Agency for collection, reuse, and recycling of leftover architectural paint.

• Prohibits manufacturers and retailers from selling architectural paint in Illinois unless the paint brand is covered by an approved stewardship program plan.

• Requires programs to establish collection sites meeting geographic standards, including at least 90% of residents within 15 miles of a site and one site per 50,000 residents in urbanized areas.

• Prohibits incineration of collected paint and mandates paint management through reuse, recycling, energy recovery, and disposal in that priority order.

• Funds the program through per-container fees included in paint purchase prices, with fees reviewed by independent auditors and approved by the Agency; manufacturers must implement approved plans within 6 months.

• Grants antitrust liability protection to manufacturers and representative organizations participating in the program as authorized by state policy.
