IL SB3695

Expands the definition of "private information" under the Freedom of Information Act to explicitly include electronic medical records and information extracted from HIPAA-covered entity systems, with protections for patient identification in compliance with HIPAA and state/federal medical privacy laws.

Adds new exemption (mm) to Section 7 protecting all protected health information as defined by 45 CFR 160.103 contained within or extracted from records held by HIPAA-covered entities, including information that alone or combined could allow patient identification.

Clarifies that medical records exemptions apply to information maintained by Health Insurance Portability and Accountability Act (HIPAA) covered entities and extracted from electronic medical records systems operated by such entities.

Maintains existing exemptions for trade secrets, personal information, and law enforcement records while adding enhanced protections specifically for medical and health information held by public bodies.
