IL SB3729

Prohibits pharmacy benefit managers and third-party payers from including discriminatory provisions in contracts with 340B covered entities, including lower reimbursement rates, additional fees, billing modifiers, or network exclusions based on 340B program participation.

Establishes that violations of these prohibitions by pharmacy benefit managers constitute unfair or deceptive insurance practices, with violating provisions being void and unenforceable for contracts entered into, amended, or renewed after July 1, 2022.

Requires the Department of Healthcare and Family Services to implement by January 1, 2023 a mechanism for 340B entities and contracted pharmacies to submit quarterly utilization files for Medicaid drug rebate processing, without requiring additional billing codes to identify 340B drugs.

Applies the same 340B anti-discrimination protections to Medicaid managed care organizations and their pharmacy benefit managers administering benefits on behalf of Medicaid managed care organizations.

Effective July 1, 2022.
