IL SB3766

Amends the Local Records Act to prohibit use of applications, software, or technology that prevents maintenance or preservation of public records through encryption, automatic deletion, or other means.

Designates use of technology that results in public records existing outside the possession or control of a public body as concealment of a public record, which is prohibited.

Maintains existing prohibition against mutilation, destruction, transfer, removal, or damage to public records, with violations constituting a Class 4 felony.

Preserves existing provisions allowing law enforcement agencies to delete or retract arrest records when investigation reveals the arrested person was not the individual the arresting officer believed them to be.
