Fleeing or attempting to elude a peace officer while in a stolen vehicle is a Class 4 felony, with a third or subsequent violation elevated to a Class 2 felony.

Aggravated fleeing or attempting to elude a peace officer while in a stolen vehicle is a Class 3 felony, with a second or subsequent violation elevated to a Class 1 felony.

Existing penalties for fleeing or eluding a peace officer (Class A misdemeanor for basic violation, Class 4 felony for third or subsequent violation) remain unchanged when the vehicle is not stolen.

Existing penalties for aggravated fleeing or eluding remain in effect for non-stolen vehicles (Class 4 felony for first violation, Class 3 felony for second or subsequent violation).

Act takes effect immediately upon becoming law.
