IL SB3864

Amends the Criminal Code to add an exemption for licensed private detectives and registered employees of licensed private detective agencies who install electronic tracking devices for legitimate business purposes, provided the vehicle is not owned, leased, or operated by someone under the protection of a protective order.

Requires private detectives to request confirmation from the Illinois State Police before installing a tracking device to verify that neither the vehicle owner/lessee nor their immediate family members are under the protection of a protective order.

Defines "immediate family member" as a spouse, parent, son, daughter, son-in-law, daughter-in-law, brother, or sister.

Defines "protective order" to include orders issued under domestic violence, stalking, civil no contact, and firearms restraining order statutes.

Establishes that private detectives may not disclose protective order information obtained from the Illinois State Police except as permitted by law, and must disclose the purpose of any installed tracking device upon request from law enforcement.
