SB3880 Summary

• Expands DNA collection requirements from specific felonies (first degree murder, home invasion, sexual assault offenses) to any felony arrest, effective January 1, 2023.

• Requires arresting agencies to collect blood, saliva, or tissue specimens at booking for all felony arrests and submit specimens to Illinois State Police within 14 days following a probable cause finding.

• Mandates destruction of DNA specimens as soon as practicable if a judge finds no probable cause to believe the arrestee committed the offense.

• Maintains existing DNA database provisions regarding confidentiality, authorized uses for law enforcement and prosecution, and expungement procedures for acquittals or convictions reversed on grounds of actual innocence.
