Public utilities providing both water and wastewater services may request in general rate case proceedings that the Illinois Commerce Commission allocate portions of one service's revenue requirement to the other service or combine both revenue requirements.

The Commission must consider seven specified factors when evaluating allocation requests, including current rates, customer numbers, capital investment impacts, future infrastructure needs, and other state or Commission policy objectives.

Water or wastewater service revenue requirements may not increase by more than 2.5% through allocation from the other service's revenue requirement.

Utilities requesting allocation must notify customers with a description of the request, estimated bill impact, and any other information the Commission deems necessary.

The provision expires and is repealed on December 31, 2026; the Commission may adopt rules to implement the amendment.
