HB1543 Summary

• Requires employees to prove by preponderance of credible evidence that accidental injuries arose out of and in the course of employment, with the accident significantly causing or contributing to both the resulting condition and disability.

• Excludes injuries from workers' compensation if the hazard was not incidental to employment or exposed the general public equally, if the accident did not occur at a required time and place, or if the disability resulted from a personal risk.

• Limits repetitive or cumulative trauma compensation to cases where the trauma significantly caused or contributed to both the medical condition and disability, excluding ordinary deterioration from aging or normal daily activities.

• Allows liability to shift to an immediate prior employer if repetitive or cumulative trauma exposure lasted fewer than 3 months and significantly contributed to the injury.

• Requires injury, occupational cause, and resulting disability manifestations to be established to a reasonable degree of medical certainty based on objective relevant medical evidence.
