HB1641 Summary

• Expands the definition of "representation case" to include matters before units of local government, in addition to State agencies.

• Prohibits legislators from participating in representation cases where the State or local government is an adverse party or where the result would adversely affect State or local revenue, finances, health, safety, welfare, or tax burden of residents.

• Prohibits (rather than permits) legislators from participating in representation cases when they maintain a close economic association with the parties involved.

• Creates new restrictions preventing legislators and government employees from deriving income or compensation from providing expert testimony against the interests of the State or local government in judicial or quasi-judicial proceedings.

• Requires legislators to officially recuse themselves from legislative matters in which they, their spouse, or immediate family members have a financial interest, and mandates written explanation for each recusal.
