IL HB2039

Authorizes certified local health departments to request and receive public health data (birth/death certificates, hospital discharge data, cancer registry data, prescription monitoring program data, etc.) from state departments for purposes of preventing or controlling disease, injury, or disability.

Requires state departments and certified local health departments to implement administrative, physical, and technical safeguards to protect data privacy and security, with access limited to minimum necessary basis for authorized personnel only.

Mandates data use agreements between state departments and certified local health departments that specify data content, format, transfer methods, and safeguarding requirements, with state departments required to execute a single master agreement covering all datasets.

Requires state departments to provide the latest available data within 120 business days after master data use agreement completion, and exempts all data obtained under this act from Freedom of Information Act disclosure and from use as evidence in legal proceedings.

Adds new exemption (pp) to the Freedom of Information Act protecting information obtained by certified local health departments under the Access to Public Health Data Act, and clarifies that state vital records regulations cannot restrict local health department access to vital records for public health purposes.
