IL HB2040

Amends the Illinois Highway Code to allow boards of trustees in counties organized under Division 2-1 of the Counties Code to appoint non-residents or those with less than one year residency as highway commissioners or clerks, or contract with neighboring townships for these services.

Increases the population threshold for Division 2-1 counties from 500 to 1,000 residents to qualify for non-resident appointment or service contracting when no qualified local candidates are willing to serve.

Creates similar provisions for Division 2-4 counties, allowing appointment of non-residents or less-than-one-year residents as highway commissioners or clerks when no qualified local candidates willing to serve exist.

Requires that all three conditions be met in Division 2-1 counties: the district is in a township with no incorporated town, population under 1,000, and no qualified one-year resident willing to serve.

Clarifies that residency and eligibility requirements apply to both highway commissioners and clerks in road districts that elect a clerk.
