HB2041 Summary

• Repeals Section 5.719 of the State Finance Act and Section 14.10 of the Private College Act.

• Amends the Higher Education Housing and Opportunities Act to add "in this State" to the definition of institutions of higher education and expands definitions of "student experiencing homelessness" and "student in care."

• Expands the Preventing Sexual Violence in Higher Education Act to include Illinois Community College Board oversight of sexual misconduct climate surveys alongside the Board of Higher Education, with deadline changes for survey delivery to July 31, 2023 and Task Force dissolution after 2027 survey completion.

• Modifies the Board of Higher Education Act to extend the terms of public university and private college board representatives from one year to three years, and changes the tuition waiver reporting deadline from July 1, 2020 to November 1, 2023.

• Increases the maximum civil penalty under the Private College Act from $100 to $10,000 per violation and directs the Academic Quality Assurance Fund to support enforcement of both the Academic Degree Act and Private College Act.
