Vegetation within 8 feet of the highway surface or shoulder may be mowed at any time but not below 4 inches in height.

Other vegetation in rights-of-way may be mowed up to 2 times between October 15 and April 1, and up to 2 times between July 1 and July 20, but not below 12 inches in height.

Additional mowing outside these periods or at lower heights requires authorization for safety reasons through Department of Transportation rules or local ordinances (that do not conflict with Department rules).

Department of Transportation may adopt rules for noxious weed control with minimal habitat disruption and for land preparation to establish native vegetation or prairie management.

Violations are petty offenses for first offense and Class B misdemeanors for subsequent offenses; the Attorney General may prosecute if local prosecutors do not.
