HB2121 Summary

• Amends the Fireworks Regulation Act of Illinois and the Pyrotechnic Use Act to redefine what products are excluded from the definition of "fireworks" and "consumer fireworks."

• Expands the sparkler exemption to include handheld or ground-based sparklers that are nonexplosive and nonaerial, containing 75 grams or less of pyrotechnic composition per tube or a total of 500 grams or less for multiple tubes, and may produce crackling or whistling effects.

• Adds a separate exemption for wood stick or wire sparklers containing not more than 100 grams of pyrotechnic mixture per item, allowing their sale and use at all times.

• Applies the same sparkler exemptions to both the Fireworks Regulation Act (425 ILCS 30/2) and the Pyrotechnic Use Act (425 ILCS 35/1).

• Takes effect January 1, 2024.
