HB2202 - Underground Carbon Dioxide Storage Act

• Creates regulatory framework for underground carbon dioxide storage in Illinois, requiring storage operators to obtain both federal UIC Class VI permits and state permits from the Department of Natural Resources.

• Establishes pore space ownership with surface estate owners retaining rights unless expressly modified, with 20-year time limit for operators to begin injection or easements/leases revert to surface owners.

• Allows Department to mandate integration of multiple pore space owners if operator obtains consent from at least 61% of surface area owners and makes good faith efforts to obtain all consents, with equitable compensation for non-consenting owners.

• Creates two dedicated funds: Carbon Dioxide Storage Administrative Fund ($0.06 per ton of CO2 injected annually) for operational regulation, and Carbon Dioxide Long-Term Trust Fund ($0.02 per ton upon project completion) for long-term monitoring.

• Upon certificate of project completion, title and liability for storage facility transfers to the State, and operators are released from all regulatory responsibilities and potential liability associated with the facility.
