IL HB2269

Renames the "Electronic Wills and Remote Witnesses Act" to the "Electronic Wills, Electronic Estate Planning Documents, and Remote Witnesses Act" throughout the Probate Act of 1975 and related statutes.

Adds Article 11 to establish a comprehensive framework for electronic nontestamentary estate planning documents, including electronic signatures on trusts, powers of attorney, advance directives, guardianship nominations, and other estate planning instruments.

Permits electronic signatures and electronic presence (via audio-video communication) to satisfy signature, witnessing, and attestation requirements for nontestamentary estate planning documents under Illinois law.

Establishes that electronic records and signatures on nontestamentary estate planning documents cannot be denied legal effect solely because they are in electronic form and must satisfy writing and signature requirements under state law.

Takes effect January 1, 2024, and applies to electronic nontestamentary estate planning documents created, signed, or stored before, on, or after the effective date.
