HB2418 Summary

• Amends the Criminal Identification Act to allow trafficking victims to petition for vacation and expungement or immediate sealing of criminal records upon completion of their last sentence if their participation in the offense resulted from human trafficking.

• Permits trafficking victims to file petitions under Supreme Court Rule 9 and allows courts to permit remote hearing attendance and under-seal filing if public filing poses a risk of harm to the petitioner.

• Requires petitioners to demonstrate by preponderance of evidence that they were trafficking victims and their offense participation resulted from trafficking under Section 10-9 of the Criminal Code of 2012 or the federal Trafficking Victims Protection Act.

• Removes the word "direct" from the causation requirement, changing it from "direct result" to simply "result" of human trafficking in multiple sections governing trafficking victim relief.

• Applies to adults and minors prosecuted as adults, cumulative with existing expungement and sealing rights under the Criminal Identification Act.
