Department of Transportation sets and charges assessment fees on haulers for each vehicle deposit of solid waste or municipal waste into Illinois landfills.

Department establishes separate regional assessment fees based on population and average hauler service charges within each region.

Assessment fee revenues are deposited into the Waste Cleanup Assessment Fund, a new special fund in the State treasury.

Fund revenues may be used for grants or payments to counties and municipalities within 50 miles of a landfill to clean up waste that falls from hauler vehicles.

Department of Transportation shall adopt rules to implement the assessment fee provisions.
