HB2431 Summary

• Amends Illinois Vehicle Code Section 12-610.2 to add tablets to the definition of electronic communication devices prohibited while driving

• Expands the ban on electronic device use while operating a motor vehicle to include watching or streaming video, participating in video conferencing applications (Zoom, Microsoft Teams, WebEx), and accessing social media sites (Facebook, Snapchat, Instagram, Twitter)

• Specifies that hands-free mode exemptions (paragraphs 3 and 9 of subsection d) do not apply when using devices for video streaming, video conferencing, or social media access

• Maintains penalty structure: $75 for first offense, $100 for second, $125 for third, and $150 for fourth or subsequent violations; minimum $1,000 fine for aggravated violations resulting in injury or death

• Defines aggravated use as a Class A misdemeanor if causing great bodily harm, permanent disability, or disfigurement, and a Class 4 felony if resulting in death
