HB2611 Summary

• Prohibits government agents from entering homes or private land without a search warrant except for: property owner permission, life-threatening emergencies, preventing unlawful wildlife killing, dispatching distressed wildlife, or apprehending fleeing suspects with probable cause.

• Requires government agents equipped with body cameras to keep them activated, unobstructed, and recording during all time spent on private property.

• Declares evidence obtained from searches violating this Act inadmissible in administrative, civil, or criminal proceedings and voids any arrests made pursuant to such violations.

• Allows persons whose rights are violated to sue for actual damages and permits prevailing plaintiffs to recover declaratory relief, injunctive relief, compensatory damages, nominal damages, and attorney's fees.

• Prohibits seizure of private property without individualized probable cause of criminal offense and requires government agents to notify landowners when entering private land when reasonably possible.
