HB2755 Summary

• Removes the requirement that retail establishments receive 7 days' notice before court proceedings in retail theft, organized retail crime, fraud, and looting cases.

• Prohibits law enforcement officers from refusing to complete written reports on domestic abuse, sexual assault, or sexual abuse incidents, and prevents officers from discouraging victims from filing police reports.

• Expands eligibility for conviction vacation to any offense (not just prostitution) committed by human trafficking victims, using preponderance of evidence standard with rebuttable presumption when evidence of trafficking status exists.

• Allows defendants whose trafficking convictions are vacated to file expedited expungement or sealing petitions, heard by the same judge within 30 days' notice to relevant parties.

• Makes conforming amendments to domestic violence reporting requirements under the Illinois Domestic Violence Act of 1986.
