HB3061 Summary

• Certified firearm dealers and their employees who sell or transfer firearms must receive at least 2 hours of annual training on recognizing individuals with mental illness, mental impairment, or mental disease that would make them a clear and present danger to themselves or others if armed.

• Federally licensed firearm dealers selling or delivering firearms in Illinois and exempt from state certification requirements are also required to receive the same mental health recognition training.

• Illinois State Police may adopt rules regarding continuing education for certified licensees on how to recognize individuals with mental illness or impairment who pose a clear and present danger if in possession of firearms.

• Violation of the training requirement by a federally licensed firearm dealer constitutes a Class A misdemeanor under the Criminal Code.

• Defines "clear and present danger" by reference to the Firearm Owners Identification Card Act.
