HB3158: Natural Organic Reduction Regulation Act

• Establishes comprehensive state regulation of natural organic reduction (NOR) facilities and authorizes the Illinois Comptroller to license disposition authorities to operate NOR facilities, requiring a $100 application fee and $100 renewal fee every 5 years.

• Requires NOR operators to complete training certification and 2-hour continuing education every 5 years; mandates that human remains not be reduced within 24 hours of death and prohibits reduction of embalmed remains, with exceptions for religious requirements.

• Establishes detailed authorization requirements including signed natural organic reduction forms from next of kin or legal authorizing agents, with specific disclosures about viewing, hazardous implants, and final disposition of reduced remains.

• Requires disposition authorities to conduct material testing of reduced remains for physical contaminants (less than 0.01 mg/kg dry weight) and pathogens using accredited laboratories, with initial testing of first 20 instances and ongoing testing of 25% of monthly instances.

• Permits final disposition of reduced remains through burial, entombment, inurnment, scattering, or integration into soil with property owner consent; authorizes disposition authorities to dispose of unclaimed remains after 60 days and establishes penalties ranging from Class 4 felonies to misdemeanors and civil penalties up to $5,000 per violation.
