IL HB3204

Amends the Biometric Information Privacy Act (740 ILCS 14/20) to establish a statute of limitations for civil actions.

Requires actions for violations to be commenced within one year of either the date of the violation or the date the aggrieved person discovers the violation, whichever applies.

Maintains existing remedies for prevailing parties including liquidated damages ($1,000 for negligent violations, $5,000 for intentional/reckless violations), actual damages, attorneys' fees, costs, and injunctive relief.

Preserves the right to bring actions in state circuit courts or as supplemental claims in federal district courts.
