HB3304 Summary

• Adds a new subsection (o) to Section 3-6 of the Criminal Code extending the statute of limitations for prosecuting COVID-19 relief fraud offenses to 5 years after discovery of the offense by authorities, with a maximum extension of 10 years beyond the standard limitation period.

• Applies the extended statute of limitations to fraud involving the Paycheck Protection Program, COVID-19 Economic Injury Disaster Loan Program, and Unemployment Benefit Programs.

• Allows prosecution to commence within 5 years after discovery by a person with legal duty to report, or within 5 years after the proper prosecuting officer becomes aware of the offense.
